The FACTORY GIRL actress has been single since she permanently split from JUDE LAW in November (06), and Burke has previously dated KATE MOSS and LINDSAY LOHAN.

An onlooker tells the New York Daily News, "There was no Fashion Week party or anything there at the time - they were just making out."
